Terms of Service

Last updated: November 2026

These Terms of Service ("Terms") govern your use of onAI, the AI workspace operated by Telesoft AG at app.onaihq.com and on dedicated instances we run for you (the "Service"). By creating an account, buying a subscription or using the Service, you agree to these Terms. If you use the Service on behalf of an organisation, you confirm that you may bind that organisation, and "you" means the organisation.

1. Provider

Telesoft AG

Weisserlenweg 7
8966 Oberwil-Lieli
Switzerland

Support: hello@onaihq.com

2. The Service

onAI is a software service that gives you and your team one interface to work with AI: chat with language models, search your connected sources (such as Microsoft 365), translate text and documents, and create images in Image Studio.

onAI is an independent product. It connects to AI models from third-party providers (for example Mistral, OpenAI, Anthropic, Google or Black Forest Labs) as integrations. onAI is not affiliated with, endorsed by or sponsored by these providers, and their names and trademarks belong to them. Which models are available can change as providers add, change or retire models.

We develop the Service continuously. We may change or remove features as long as the core function you paid for stays available.

3. Accounts

  • You must give accurate information when you sign up and keep it up to date.
  • You must be at least 18 years old, or the age of majority where you live, to use the Service.
  • You are responsible for keeping your sign-in credentials secret and for all activity under your account. Tell us at once at hello@onaihq.com if you suspect misuse.
  • Workspace owners and administrators decide who in their organisation gets access, which models and features are switched on, and which usage limits apply.

4. Acceptable use and content rules

You must follow our Acceptable Use Policy, which is part of these Terms. In particular, you must not use the Service to create, request or share:

  • sexual, pornographic, explicit or sexually suggestive content (NSFW content), including nudity, of anyone. Content that sexualises minors is forbidden without exception and will be reported to the authorities;
  • deepfakes, face swaps or other manipulated images of real people, or content that impersonates a real person;
  • content that is illegal, violent, hateful, harassing, or that infringes the rights of others;
  • malware, attacks on systems, or attempts to get around our safety checks.

We check prompts for image generation automatically before an image is created and block prompts that break these rules. We may suspend or close accounts that break these rules, without refund where the law allows.

5. Your content and AI output

  • You keep all rights to what you put into the Service (prompts, files, data) and, as between you and us, to the output the Service generates for you.
  • You give us the rights we need to process your content for the sole purpose of providing the Service to you, including sending it to the AI model providers you or your administrators choose.
  • We do not sell your content and do not use it to train AI models.
  • AI output can be wrong, incomplete or similar to output given to others. Check output before you rely on it, especially for legal, medical, financial or other important decisions. You are responsible for how you use output.
  • You are responsible for having the rights to the content you upload and for making sure your use of output does not infringe the rights of others.

6. Prices, payment and taxes

  • Current prices are shown in the pricing section and in the app before you buy. The Per seat plan includes a monthly model budget per seat. Usage beyond the included budget is billed at actual consumption, as shown in the usage journal.
  • Online purchases are processed by our reseller and Merchant of Record, Creem. Creem handles payment, invoicing and sales tax or VAT. Creem's terms of sale apply to the payment transaction, and your bank statement may show Creem as the seller.
  • Flat-price, dedicated and on-premises plans are agreed in a separate written offer or contract, which takes precedence over these Terms where they differ.
  • If a payment fails, we may limit the Service until the open amount is paid.
  • We may change prices for future billing periods. We will tell you at least 30 days in advance, and you can cancel before the change takes effect.

7. Subscriptions, cancellation and refunds

  • Subscriptions renew automatically at the end of each billing period until cancelled.
  • You can cancel at any time in the app's billing settings ("Cancel renewal") or in the Creem customer portal linked there. Paid access continues until the end of the current billing period.
  • Payments are non-refundable, except where the law requires a refund or as set out below. These Terms do not override mandatory local laws on your cancellation rights.
  • Consumers in the EU/EEA and the UK: if you cancel within 14 days of your first subscription purchase, you get a prorated refund for the unused part of the billing period. This applies to the first purchase, not to renewals.
  • AI usage is not refundable once used. Usage (for example tokens, images, translations and searches), whether included in a plan, billed by consumption or bought as credits, is provided in full the moment you use it and cannot be returned. By using it, you expressly ask us to provide it immediately and acknowledge that you lose any right of withdrawal for usage already consumed.
  • Credits: any prepaid or promotional credits are non-refundable and non-transferable, and expire 12 months after purchase or issuance unless stated otherwise when you get them.
  • Exceptions: we refund billing errors, charges you did not authorise, and charges for periods in which the Service failed through our fault. Write to hello@onaihq.com within 30 days of the charge.

8. Support

Support is available by email at hello@onaihq.com. We reply within 3 business days. Service status is published at onai.instatus.com.

9. Availability

We aim to keep the Service available at all times but do not guarantee uninterrupted availability unless agreed in writing. Maintenance, faults at third-party providers (including AI model providers) and events outside our control can cause interruptions.

10. Privacy and data processing

How we handle personal data is described in our Privacy Policy. Where we process personal data on behalf of your organisation, we do so as a processor under a data processing agreement, which you can request at hello@onaihq.com.

11. Suspension and termination

You can stop using the Service and cancel at any time. We may suspend or end your access with immediate effect if you seriously or repeatedly break these Terms or the Acceptable Use Policy, if required by law, or to protect the Service or others. In other cases we give at least 30 days' notice. After your account ends, we delete your content within the periods described in the Privacy Policy, unless the law requires us to keep it.

12. Liability

We are liable without limitation for damage caused intentionally or by gross negligence, and for personal injury. Otherwise, to the extent permitted by law, our total liability is limited to the fees you paid for the Service in the 12 months before the damage occurred, and we are not liable for indirect or consequential damage, lost profit or lost data.

Mandatory consumer protection law remains unaffected.

13. Changes to these Terms

We may update these Terms. We will tell you about material changes at least 30 days before they take effect, by email or in the app. If you do not agree, you can cancel before the changes take effect.

14. Governing law and jurisdiction

These Terms are governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods. The courts at the registered office of Telesoft AG have exclusive jurisdiction. If you are a consumer, you may also rely on the mandatory law and courts of your country of residence.
